Contract law

DIY sliding wardrobes is owned and wholly operated by Prestige Fitted Wardrobes Ltd. Purchases on the web or over the telephone are made from Prestige Fitted Wardrobes Ltd. The company is a UK company with trading address 3B Boyton Hall Farm, Chelmsford, Essex, CM1 4LN. The company registration number is 11324754. The company VAT number is 305277614. VAT is charged on all UK purchases at the standard rate of 20%.

Customers accept that by dealing with the Company they agree to the Terms and Conditions contained in this website and that any contract formed with the Company will be a contract under the subject to the laws of England whose courts will have exclusive jurisdiction in the determination of any disputes.

By placing and completing an order via this website you agree to have understood and accepted these terms & conditions.

Making a purchase

The placement of an order indicates your acceptance of these terms and conditions. To order goods you must be at least 18 years of age. We will treat each order for goods as an offer by you to purchase the goods subject to these terms and conditions.

All our products are manufactured and processed here in the UK. We will deliver all UK orders within a maximum of 30 working days from date of payment.

Description of goods & tolerances

As all the products that we sell are of a technical nature it is not practical to publish detailed specifications of all the products. All images, descriptive matter, specifications and advertising on our website are for the sole purpose of giving an approximate description of the goods. All specifications given to the Customer are approximate and intended as a guide only. We do not accept responsibility for any preparation work based on such specifications. We endeavour to ensure product descriptions are correct but there may be some colour deviance and small deviances in size tolerance while in the production process which are considered acceptable manufacturing tolerances, and these are outlined below –

Sliding Wardrobe Doors and Sliding Room Dividers can have a deviance + / – 5mm

Our intention is that all information on the website should be as accurate and up to date as possible. However, we cannot guarantee the reliability, or the accuracy of the information contained within its pages.

We reserve the right to change product specification without prior notice. Due to differences in models of monitors, printers and other viewing devices including individual settings on your computer we cannot guarantee that colours on images on our website are the exact and final colour of the item.

Fitting your product

We accept no responsibility at all in respect of whether your walls are appropriate for the product you are purchasing or in relation to the fitting of your products. Upon placing your order, a fitting guide will be emailed to you. 

We strongly advise that you do not engage in any preparatory work until full receipt of your goods.

Our contract and acceptance of your order

If goods are ordered after 12.00pm on a weekday, over the weekend or on a bank holiday the order date is taken as the following working day for delivery purposes. If a delivery would normally fall due over the Christmas shut down period, the delivery period may be extended to a later date. After completion of your order please check your receipt and ensure that all the details are correct. If you are in any doubt, please contact us immediately via email or telephone.

Any contract for purchases made will be with Prestige Fitted Wardrobes Ltd. DIY Sliding Wardrobes must receive payment in full for the goods that you order before your order can be accepted and the contract formed.

When you place an order to purchase a product from DIY Sliding Wardrobes and payment has been received, we will confirm your order by sending you an e-mail to you at the email address you have provided confirming receipt of your order and containing the details of your order. DIY Sliding Wardrobes acceptance of your order brings into existence a legally binding contract between us on these terms. Any term sought to be imposed by you will not form part of the contract.

DIY Sliding Wardrobes is entitled to withdraw from any contract in the case of obvious errors or inaccuracies regarding the goods appearing on our website. We will contact you as soon as possible by e-mail. This will be to inform you of the correct price of the goods, and to ask you if you wish to continue with the order at the amended price, or to cancel the order altogether.

Payment and price

We are entitled to make adjustments to the price if there is an error or omission to the price published whether or not the order has been confirmed. We ask that all goods be paid for on completion of order and that all funds are cleared prior to delivery. We accept most major credit and debit cards such as VISA, MASTERCARD, and MAESTRO. On the order you must provide us with your exact billing address and a contact telephone number. Incorrect information will cause a delay in processing your order. Your order will only be processed once authorisation of your credit card has been properly received.

The total price payable for the goods will be stipulated at the time you place your order whether or not the order has been confirmed. All prices are inclusive of VAT but exclusive of delivery charges which will be payable as indicated at the time of placing your order, unless stated otherwise.

If an error or inaccuracy is discovered with regards to the advertised price of the goods that you have ordered, we will contact you as soon as possible by email or telephone. This will be to inform you of the correct price of the goods, and to ask you if you wish to continue with the order at the amended price, or to cancel the order altogether.

Back orders

In the unlikely event we cannot complete your order on time due to stocking issues we will back order for you. At the time of placing this back order you will be given the option to cancel your order if you would rather not wait. All back orders will be notified of new delivery date within 48 hours. You will be given an opportunity to cancel again at this time.

Availability of goods

All products and services are subject to availability and may be withdrawn at any time. If we do not supply the goods for any reason, we will not charge you for these and we will refund any money already paid for them.

Deliveries

Free Delivery is not available for all postcodes. For these postcodes a delivery charge will be applicable for orders over £500. This will be calculated at checkout. 

We pride ourselves on our ability to offer fast turnaround times from placing an order to delivering the goods. However, any time or date for delivery stated by the Company shall be treated as an estimate only. No liability can be accepted by the Company for failure to deliver within any specific time period. The Company shall not be liable for any loss or damage whatsoever (including consequential loss or loss of profit) arising directly or indirectly from any delay in the delivery of all or any of the goods howsoever caused.

The Company shall accept no liability for shortages or damage to goods unless the Customer reports the damage at the time of delivery.

We offer delivery to mainland UK on all glass mirrors and other glass products; however, some restrictions apply to Scottish Highlands and some areas of Wales. Please contact us if you are in either of those areas, prior to placing an order to get a delivery quote. It is with regret we cannot deliver to Ireland or UK Islands.

Delivery dates are approximate and are not the essence of the contract. You are advised not to arrange installation of the items until after they have been delivered and checked for damage.

We aim to dispatch your order as quickly as possible but aim for all orders to be completed within a maximum of 100 working days of the order being placed. We will give all the information we can about the expected day of delivery within 2 working days of the order being placed and will confirm whether am or pm delivery time via email or telephone the day prior to delivery. If any item is out of stock, we will email or telephone you to advise you of the new expected delivery date. You must indicate if you wish to take advantage of this service.

If for any reason expected delivery will exceed 30 days from the date of receipt of order the customer will be informed and given the opportunity to cancel the order. However, all delivery dates given are only and always provisional. Goods are subject to availability and delay in delivery of goods is sometimes outside of our control, and we accept no liability whatsoever in respect to late deliveries.

The delivery drivers are not insured to take their vehicles on roads other than public highways. If you live in a remote location and your home is not on a public road, e.g. if you live at the end of a farm track, then the driver will deliver the goods to the end of the public road only. You accept this when placing your order and if you refuse the delivery because of the driver cannot drop at your door then you will be charged any additional delivery costs, restocking and collection fees.

The driver will move the individual items to a single location of your choice outside the property. The drivers may be prepared to assist with moving the items into the property, but this is entirely at their discretion, they are not obliged to do this. The delivery will be made by a single driver, so if the items you have ordered are heavy please ensure that an able-bodied person is available to assist the driver with the carrying. For Health and Safety reasons the driver cannot carry heavy items on his own. While the driver may be prepared to assist with moving the items inside the property, they will not be prepared to negotiate any stairs. We cannot be held liable for any damages if your order is taken higher than ground floor and/or you damage it whilst moving.

Without prejudice to the statutory rights afforded to consumers under English law, DIY Sliding Wardrobes accepts no liability for any failure to ship products where this results from its inability to do so resulting from acts of god, civil commotion, riots, flood, drought, fire, legislation or other factors outside it’s control, or its decision on reasonable grounds not to do so for reasons of suspicion of credit card fraud or similar, provided that it takes all reasonable steps to notify you within fourteen (14) days of order placement that products will not be shipped as ordered. In such cases Wardrobe Doors Direct will not process any payment or will immediately refund any payment made, in full.

Checking Goods for Damage and Notifying DIY Sliding Wardrobes.

All goods must be checked for damage before signing the driver’s delivery note. If you sign for the goods, even if you write the words “Unchecked” or similar on the delivery note, then you are accepting that the goods arrived in good condition and later claims for damages or missing items will not be considered. If the driver refuses to wait while you check the goods, then you must refuse to accept the delivery and contact us with the details as soon as possible.

If someone else is signing for the goods on your behalf, you agree to advise them that the goods must be checked, and you accept full responsibility for any loss or damage if they sign on your behalf and fail to check. You agree to indemnify us in full for any losses we suffer as a result of you or your agent accepting goods and signing a delivery note without thoroughly checking the goods for damage.

Damaged / Missing goods

You must notify us of any damage within 24 hours of the delivery. If we are not notified of damage within 24 hours, we cannot accept your claim. You agree to indemnify us in full for any losses we suffer as a result of your failure to notify us within 24 hours.

If an item on a delivery is damaged, make a note of the damaged item on the delivery paperwork and contact us with the details. Do not refuse the delivery unless every item is damaged. If you refuse a delivery with any undamaged items on it, you will be charged for the return and the redelivery of those items.

Risk

As soon as we have delivered the goods to your door you will be responsible for them. We will only deliver to the address on the order and goods will not be left without a signature. From the time of receipted delivery of the goods, any loss or damage to the goods shall be at your own risk.

Returns and refunds

As the system is made to your specifications (“made to measure”) we cannot make any refund, other than a valid warranty claim once you have accepted delivery. To make a warranty claim please first do so in writing or email, then return the goods to our factory, where we will make an inspection within 2 working days. Subject to this inspection we will immediately make a refund including your actual cost to return the goods. (Please keep the invoice for the return as proof of cost). If we believe the claim to be invalid, we will immediately inform you by email with a full explanation and, where necessary, photographs. You will of course have the opportunity to present your explanation.

We would like you to be completely satisfied with your purchase, so please make sure you have read and understood the description/s thoroughly of the wardrobe doors, sliding partitions and wardrobe interiors you are ordering or have ordered from our website and that you have selected the correct items, we do not send goods out on a trial basis.

Warranty

DIY Sliding Wardrobes products have a manufacturer guaranteed for 10 years against faulty materials or workmanship subject to Specification of Goods.

Failure to carry out the recommended instructions for decorating, sealing and installation of joinery products can impair their performance and will invalidate any guarantees.

Where any valid claim in respect of the Goods which is based on any defect in the quality or condition of the Goods or their failure to meet specification is notified to DIY Sliding Wardrobes in accordance with these Conditions, DIY Sliding Wardrobes shall be entitled to replace the Goods (or the part in question) free of charge or, at the Seller’s sole discretion, refund to the buyer the price of the Goods (or a proportionate part of the price), but the Seller shall have no further liability to the buyer.

Except in respect of death or personal injury caused by the Seller’s negligence, the Seller shall not be liable to the Buyer by reason of any representation, or any implied warranty, condition or other term, or any duty at common law, or under the express terms of the Contract, for any consequential loss or damage (whether for loss of profit or otherwise), costs, expenses or other claims for consequential compensation whatsoever (and whether caused by the negligence of the Seller, its employees or agents or otherwise) which arise out of or in connection with the supply of the Goods or their use or resale by the Buyer, except as expressly provided in these Conditions.

Specification of goods

The warranty does not apply to doors which swell due to intake of excessive moisture or any other neglect including improper handling, scratched glass, broken glass and any post installation panel adjustment due to settling, overloading of shelves and interiors, impact from foreign goods, or misuse on the part of the Buyer after sale. Any damage must be notified at the time of installation in writing.

The Seller’s liability under this warranty shall not extend to costs or charges of unfixing, refixing, painting, polishing, staining, handling, cartage, storage or other additional charges or expenses. (This does not affect your statutory rights).

All Goods must be stored in a dry place. The Seller cannot accept any responsibility if Goods are not so stored.

Other

You will own the goods once we have received your payment in full. Failure by us to enforce any of these terms and conditions will not affect our right to enforce the rest of these terms and conditions. These terms and conditions are subject to change at any time without prior notice to you. Terms and Conditions do not affect your statutory rights.

Force majeure

In the event that the Company is prevented from carrying out its obligations as a result of any cause beyond its control such as – but not limited to Acts of God, War, Strikes, Lock-outs, Flood and Failure of third parties to deliver goods, the Company shall be relieved of its obligations and liabilities for as long as such fulfilment is prevented.

The company’s liability

The Company shall under no circumstances whatsoever be liable for any indirect or consequential loss howsoever caused.

The Company’s liability in respect of breach or non-performance of any order shall be limited to the invoiced value to which the claim relates.

Goods are not tested or sold as fit for any particular purposes or for use under any specific conditions.

Subject as expressly provided in these Terms and Conditions, and except where the goods are sold to a person dealing as a consumer (within the meaning of the Unfair Contract Terms Act 1977), all warranties, conditions or other terms implied by statute or common law are excluded to the fullest extent permitted by law.

Where the goods are sold under a consumer transaction (as defined by the Consumer Transactions (Restrictions on Statements) Order 1976) the statutory rights of the Customer are not affected by these Terms and Conditions.

Changes to this agreement

DIY Sliding Wardrobes reserves the right to make changes to our site, policies, and these terms and conditions at any time. If any of these conditions shall be deemed invalid, void, or for any reason unforeseen, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition.
